Terms of Service

1. Acceptance of Terms

By accessing or using Polydev AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

Polydev AI provides multi-model AI consultation through a unified MCP (Model Context Protocol) interface. The Service queries multiple AI models, compares their responses, generates rankings, and provides aggregated insights for software development assistance. The Service also includes a crowdsourced AI model leaderboard and CLI-as-API tunnel functionality.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You accept responsibility for all activities under your account and must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious code
  • Attempt unauthorized access to the Service or its systems
  • Generate content that is harmful, abusive, or violates the rights of others
  • Circumvent rate limits, access controls, or usage restrictions
  • Resell or redistribute the Service without authorization

5. API Keys and Credits

Users may provide their own API keys for third-party AI services or use Polydev credits. You are responsible for any costs incurred when using your own API keys. Credits are non-refundable and expire according to your subscription plan terms.

6. CLI-as-API Tunnel

The CLI-as-API feature routes API requests through your locally-installed AI CLI tools (Claude Code, Codex CLI, Gemini CLI). You are responsible for complying with the terms of service of each underlying CLI provider. Polydev does not guarantee availability or compatibility with any specific CLI version or provider policy.

CLI-as-API is intended for personal and development use. You are responsible for ensuring your usage complies with the terms of service of the underlying CLI subscription providers (Anthropic, OpenAI, Google).

7. Subscription and Billing

Subscriptions are billed on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods. Credit rollover is available only while your subscription is active.

8. User Content and License Grant

Ownership. You retain ownership of any code, prompts, or other content you submit to the Service ("User Content").

License to Operate. By using the Service, you grant Polydev AI a worldwide, non-exclusive, royalty-free license to process, transmit, and temporarily store your User Content as necessary to provide the Service, including routing your queries to third-party AI providers.

License for Improvement and Training. You also grant Polydev AI a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, and create derivative works from your User Content — including prompts, queries, model selections, preference signals, rankings, and comparison data — for the purposes of:

  • Improving and developing the Service, including AI model evaluation and routing
  • Training, fine-tuning, and improving AI models and algorithms (including via reinforcement learning from human feedback, RLHF, and similar techniques)
  • Building and maintaining the crowdsourced AI model leaderboard and ranking systems
  • Conducting research and publishing aggregated, anonymized findings
  • Creating datasets, benchmarks, and evaluation tools derived from aggregated usage patterns

We will use commercially reasonable efforts to anonymize and aggregate User Content before using it for training and improvement purposes. Individual prompts and code snippets will not be published in identifiable form without your explicit consent.

9. Leaderboard and Rankings Data

The Service maintains a crowdsourced AI model leaderboard powered by real developer usage. By using the Service, you acknowledge and agree that:

  • Your model selections, preference signals, and comparison outcomes contribute to public leaderboard rankings
  • Prompt metadata (category, complexity, language, framework — but not the prompt content itself) may be used to compute dimension-specific rankings
  • Aggregated usage patterns, Elo ratings, and model performance statistics derived from your usage may be published publicly
  • Rankings data may be used commercially, including in reports, APIs, or licensed datasets

10. Aggregated Data

Polydev AI may create, use, and commercialize aggregated, anonymized, and de-identified data derived from your use of the Service. This includes but is not limited to: model performance benchmarks, usage statistics, prompt category distributions, response quality metrics, and comparative model evaluations. Such aggregated data is not considered User Content and is owned by Polydev AI.

11. Intellectual Property

The Service, including its software, algorithms, ranking systems, leaderboard data, aggregated datasets, and documentation, is owned by Polydev AI and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, service marks, or trade dress.

12. Third-Party Services

The Service integrates with third-party AI providers (Anthropic, OpenAI, Google, xAI, and others). Your use of these providers through the Service is subject to their respective terms of service. Polydev AI is not responsible for the availability, accuracy, or policies of third-party providers.

13. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. AI-generated responses may contain errors, inaccuracies, or biases. Leaderboard rankings are statistical estimates and should not be taken as definitive quality assessments.

14. Limitation of Liability

In no event shall Polydev AI be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

15. Termination

We may terminate or suspend your account at any time for breach of these Terms. Upon termination, your right to use the Service ceases immediately. Sections 8 (User Content and License Grant), 9 (Leaderboard and Rankings Data), 10 (Aggregated Data), 11 (Intellectual Property), 13 (Disclaimer), and 14 (Limitation of Liability) survive termination.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions.
